Meet Utah Governor Gary Herbert. That’s him below…
On Thursday, March 23, 2017, Gov. Herbert signed into law Utah House Bill 155, thus enacting (effective December 30, 2018) the toughest DUI law in America.
Every State in the nation has a .08 BAC standard, except Utah (again, effective December 30, 2018), and some have argued that the new standard is too low, alleging that just two beers is enough to put an average man, and one glass of wine for an average woman, over the legal limit.
Governor Herbert reportedly went on record stating that the new law would improve road safety in the region. Per the Gov.: “I signed (the bill) into law to help strengthen Utah’s impaired driving laws and to reduce the number of alcohol-related deaths on our roads.” But, according to Melva Sine, who is President of the Utah Restaurant Association, the law as likely to hurt the hospitality industry in the state. Mrs. Stine reportedly opined that: “It will be punishing those people who drink responsibly, and go out and enjoy an evening.” And it has been alleged that a 150 pound man would be over the 0.05 limit after two beers, while a 120-pound woman could exceed it after a single drink (noting of course that these estimates are not accurate across the board and that they are affected by a number of factors, including how much food a person has eaten, how much sleep they have had, their tolerance level, etc.).
In response Governor Herbert will reportedly call for a special legislative session in order to address the “unintended and collateral consequences” of the law, and to help “modify and improve it”. The Gov. will reportedly seek a tiered punishment system with less stringent penalties for individuals who are convicted of DUI with a BAC in between 0.05 and 0.79 percent.
Memo to the Folks: When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is: “Don’t do it! Get a DD (Designated Driver), not a DUI”.
Memo to the Folks continued: Be smart: Don’t drink and drive, but, if you do, just say “NO{thing}”, don’t blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-381-8686, 305-798-2220 or 1-888-SHARK-8-1.
