Per a Largo Police Department police report (a copy of which you can see below) Deon had been stopped for a routine traffic infraction. When the officer approached he smelled marijuana (giving the LEO “PC” – probable cause – to transform the temporary detention info a criminal investigation) and, upon inquiry, Deon reportedly consented to a warrantless search.
The vehicle search allegedly resulted in the officer finding an envelope containing marijuana and five cell phones, which in turn led to Deon’s arrest and a search of his person incident to his arrest. Per the arresting officer “During the search [of Deon] the def would not widen his stance and was clinching his buttocks. [So] The def was transported to the PD fora more thorough search.”
At the police station and “Prior to conducting the secondary search the def admitted to having crack cocaine concealed beneath his genitals.” Dean reportedly admitted that “the marijuana was his, but denied that the cocaine belonged to him.”
Memo to the Folks: Forgetting possession / possession with intent and committing traffic infractions while in possession / possession with intent, lets tally up Deon’s mistakes: 1) Smoking dope in his car while carrying dope (alternatively not properly packaging his supply to avoid human olfactory detection); 2) Consenting to a warrantless search of his vehicle; 3) Speaking to the cops about his case; 4) Admitting to possession of marijuana (or of anything for that matter); and 5) Denying ownership of the crack that was, literally, hidden in his crack. After this debacle there are a bunch of Founding Fathers rolling all over their graves….
