Thank you for asking “Was I Entrapped in a Prostitution Sting”?

So you’re a guy driving down the street and you see a sexy woman wearing a skimpy outfit standing on the curb. She seems to be flagging you down and smiling at you. So you pull over, you roll down your passenger side window and then she asks you what you’re up to or if you want some company.

Equivocating you say “sure” and she gets in, your drive off and 3 blocks later you are surrounded by squad cars with flashing red and blue lights.

The next thing you know you are in handcuffs, charged with solicitation of prostitution, doing the “perp walk”, your mug shot goes viral and your wife and kids are disgusted.

You swear that you did nothing other than to foolishly try to help a damsel in distress, but she, an undercover police officer, swears under oath (and in writing) that you offered her $50 for oral sex.
In this example the cops clearly used methods of persuasion to induce you to commit a crime, but the law permits them to do this- and be clear that they can and that they do use trickery and subterfuge to provide folks with the opportunity, means or facilities to commit a crime… the question is whether or not you would have done the same thing if “she” hadn’t been a cop?

So… were you entrapped? Probably not. Why? Because entrapment sinks or swims on the issue of your predisposition to commit the crime regardless of police persuasion. If the Court believes the u/c cop that you offered her $ for sex then you were not entrapped.
