“What is a Furlough and am I entitled to one?”
In the criminal law context a furlough is a temporary release from custody. It is a rare act of compassion by a Judge to permit an inmate to leave custody for a limited purpose, such as to attend a funeral or to visit a dying close relative at a hospital.
No one has a right to a furlough, and while Judges are capable of compassion and understanding the fact is that there is a well-known judicial prejudice against granting furloughs.
Still, the decision of whether or not you will receive a furlough is a 100% discretionary and unreviewable call by the Judge, so, if you’re gonna ask, and if you want to increase your odds at a favorable outcome, then I suggest that you get the best, most “dialed-in”, campaign contributing, “State Attorney friendly” criminal defense lawyer that you can find to prepare and argue the most persuasive motion possible.
While that will exponentially increase your odds at success, still, and sadly, even then I wouldn’t count on the motion being granted.
