Thank you for asking me “How much time can I get for Possessing Cocaine in FL?”

Possession of any amount of cocaine is a felony in Florida.

If you possess less than 28 grams then you have committed a 3rd degree felony and you face up to 5 years in prison. But if you possess one ounce – 28 grams – or more of cocaine then you have crossed the line from mere possession to trafficking and you now face a 1st degree felony which is punishable by up to 30 years in prison.

On top of the potential 30 year sentence Trafficking charges carry minimum mandatory penalties, and, like trafficking itself, these min/mands also depend upon the amount of drugs that you possess.

In the case of cocaine if you possess in between 28 – 200 grams of cocaine then you face 30 years with a year min/mand; if you possess in between 200 – 400 grams then you face 30 years with a 7 year min/mand and if you possess in between 400 grams to 150 kilograms then you face 30 years with a 15 year minimum mandatory.

If you are found guilty of trafficking then, absent a statutory basis for departure, the court is required to sentence you to serve up to 30 years in prison, coupled with the appropriate minimum mandatory term of imprisonment.

While you will get gain time on any sentence in excess of the min/mand you must first serve the minimum mandatory, day for day, without gain time or any time off for good behavior.

There are some ways around the min/mand, but they are few and far between.
