Thank you for asking me “What is “Reasonable Force” under Stand Your Ground / SYG”
The question isn’t “what is reasonable force”; the question is “would a reasonable person who was standing in your shoes at that time, facing what you faced and knowing what you knew, have made the same decision to use the same force that you used at the time that you used it”….
I know that what I just said is convoluted so I’ll try to break it down…
Simply put: The question is “Under the circumstances, did you act reasonably?”, with the caveat that you did not have to retreat…
And the answer to the question comes from the Judge after hearing, considering and weighing the evidence.
I can’t list all of the “what is reasonable” situations but how’s about I give you a few examples of what is clearly unreasonable…
You can’t use a weapon against someone who insulted you or your mom or you girlfriend; You can’t shoot someone because their dog took a crap on your lawn; and You can’t take a baseball bat to someone for sitting on the hood of your car.
Again, your use of force must be a reasonable response to either an act or a threat of violence against you, another or your property.
