Q:  Car accident a month or so ago with possible DUI charges….  I was in a single car accident a month or so ago. My car was totaled & I don’t remember much after the crash other than the police arrived and I was taken to the hospital. I gave my consent to a blood alcohol test. I understand that the police have a year to issue a warrant if they feel they have substantial evidence in the case, but in reality wouldn’t I have heard something by now? How long does it take to get the blood work back? And wouldn’t I have been arrested on the spot? I was released from the hospital hours after being taken there.

Answered 9 months ago. They have 2 years if it is a misdemeanor accident case and 3 if it is a felony.

It takes time for them to get their ducks in a row. Months are not uncommon.

If your BAC comes back + the legal limit you will be charged.

You should consider consulting with an experienced 516 area criminal defense lawyer who’s practice primarily centers around DUI cases (DUI’s especially blood draw cases, are a niche, a specialty and your intents will be best served by hiring an expert) to grab the bull by the horns and start an offensive campaign.
