Stephen was arrested on Friday, January 29th, 2015 for DUI, but his was no ordinary DUI. Stephen was arrested during a High School Ice Hockey Game at the “South Arena”, where local girl’s team Davies High was taking on Williston High in a challenge for for female ice superiority. Stephen was not at the game as a spectator; he was operating he Zamboni (pictured below).
Stephen was arrested during the game at about 8:15 pm, after spectators and school officials noticed that the Zamboni (which is used for resurfacing – leveling – the ice during a hockey game (as well as at other similar events like basic ice skating rinks) was being driven “erratically”. Arrangements were made to have a “relief” Zamboni operator take over but the teams decided to continue play in “rough ice” instead. In the interim, the sign taped to the glass which says “Absolutely no one on ice while Zamboni is resurfacing” is a good warning, but, apparently more signs are needed.
Jim Larson, Finance and Human Resources Director for the Fargo Park District stated that Anderson, a six (6) year seasonal employee of the District, will not be returning to his Zamboni duties, most especially having now learned that apart from the immediate incident, that less than two (2) months earlier, in December, 2014, he had been arrested and convicted of both DUI and possession of marijuana and that he failed to report these charges (or convictions) to his employer. Larson says that the District’s annual background check policy would have revealed it before the end of 2015.
I am not a North Dakota licensed lawyer and therefore cannot comment on matters of ND law or procedure, but as a veteran criminal defense lawyer of 23+ years in FL I can say with 1,000% certainty that even though it’s usually just a simple foolish decision that leads to no harm to anyone but the driver / arrestee her/himself, all DUI’s are serious. They carry stiff, and life-long penalties and stigmata and, but for the grace of ________, any one of them could easily result in irreparable catastrophe. Further, I question whether or not one can earn – in FL or ND – a DUI for driving (anything) on an ice rink (as opposed to a road which is either public or open to the public ), but that is a matter for Stephen’s defense attorney to sort out. Hopefully I will be able to follow up and let you all know, assuming that I don;t get run over and killed at the next Panthers’ game….
When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is: “Don’t do it! Get a DD (Designated Driver), not a DUI”.
Be smart{er than Stephen James Ansenson}: Don’t drink and drive, but, if you do, just say “NO{thing}”, don’t blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-381-8686, 305-798-2220, **ARRESTED, **305DUI, **MIAMIDUI, **MIAMILAW or **HABERLAW.
