Meet 41 y/o Hasti Fakhrai-Bayrooti of Rancho Santa Margarita, CA. That’s her March, 2013 booking photo below…
Hasti was a licensed and practicing CA lawyer when, reportedly, at approximately 6:45 p.m. on March 15, 2013, while driving her car after having consumed prescription drugs (which blood tests confirmed to include both Xanax and Suboxone), she swerved into a bike lane, crashing into 54-year-old bicyclist Eric Billings, a father of four (4 – pictured below), who rolled over the hood and windshield and then died at the scene as a result of sustaining multiple traumatic injuries from the crash.
The victim owned a contracting company and mentored teens and young adults at a local college.
Per the Orange County, CA State Attorney’s Office press release (which you can view here), Hasti pled guilty on Tuesday, March 10th, 2015 to a felony count of vehicular manslaughter while intoxicated, and she faces a maximum sentence of four (4) years in state prison. She is out of custody on $100,000 bail and is scheduled to be sentenced on May 8, 2015, at 8:30 a.m. in Department H-13, Harbor Justice Center, Newport Beach.
In an interview after the crash but before her guilty plea, Hasti reportedly expressed remorse over the incident, stating that the ordeal had taken a toll on her, even leading to a suicide attempt. She claimed that “I get out of bed with no purpose. I go to bed with no purpose… I don’t know if I’ll get better, if I won’t get better. Sometimes I wish to God it was me and not [Billings].” She claimed that she had been diagnosed with manic depression, Obsessive Compulsive Disorder, and suffers from Post Traumatic Stress Disorder, that she was taking medication for the illnesses and feared, then, that the presence of antidepressants in her blood would lead to a conviction. And guess what? A) She was right and B) You don’t have to be a lawyer to figure that out.
In Florida (and in most states) you can get a DUI for driving while impaired / under the influence of either alcohol or a controlled / scheduled substance. In the latter case blood work is likely the kiss of death, and you can be venipunctured against your will where there is an accident involving either death or serious bodily injury. Do yourself a favor and read the warning labels on your Rx meds. Don’t mix them with booze (unless you are hanging on your couch and have a good feel for your bodily tolerances) and don’t get behind the wheel if you are advised not to do so.
When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is: “Don’t do it! Get a DD (Designated Driver), not a DUI”.
Be smart{er than Attorney Hasti Fakhrai-Bayrooti}: Don’t drink and drive, but, if you do, just say “NO{thing}”, don’t blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 1-888-SHARK-8-1, 305-381-8686 or 305-798-2220.
