Q:     Is it a crime to keep jewelry that was found in the bank? And if yes, what should I do at this point?  Went to the bank to get some paperwork out of my safety deposit box from the vault. I needed to use the room. I walked in to the room and saw a small jewelry box on the chair. My guess person who used the room before me left it on the chair. I took it. I regret making that decision. No one came out of the room before me. Bank employees also check the room after every person leaves. I was thinking to return the box back but I am afraid I can end up in big trouble. Also I am on the verge of divorce and my spouse knows about the incident. Is it a crime? What should I do at this point? Very much appreciate your response.

Answered I am not a KY lawyer so I cannot comment on matters of KY law or procedure. However, had you asked this question in Florida, where I have been a practicing criminal defense attorney for nearly a quarter of a century, then I would say that it is theft. Plain and simple. I would further state that the bank probably has surveillance cameras and that there is a good chance that you were captured removing the property in question.

That said there is also a good chance that the moron who left their jewelry out likely won’t discover his / her mistake until the next time their s/he goes to the bank, which could be longer than the time that the bank maintains their security surveillance footage.

Regardless, personally, and as a matter of law, ethics and karma, I would return the property, but I would do it smart, to wit: through a lawyer or other “buffer” / middleman rather than on my own.  I am relatively confident that such a return can be handled without incident if it is properly brokered.
