There is no “set in stone” time frame for being released from a jail facility. Not only does each jail vary from location to location, but even the same facility will vary itself from day to day and from shift to shift. Factors such as the time of day, the number of people being booked, the amount of personnel on site and the cooperation level of both the correctional staff and the inmates all enter into the “how long will it take to get the hell out of here” calculus.
Make no mistake that the correctional staff can make your experience “better” or significantly “worse”, as well as can (and will) effect the time frame in which you are processed. Most jail facility booking processes resemble a “cattle call” more than a human experience. Your attitude, demeanor and general level of cooperation will determine if your personal cattle call falls into the “petting zoo” versus the “slaughterhouse” variety of experiences.
That said, some cases – based solely upon the booking charge – necessarily take longer than others for release purposes. For example, in Florida if you are booked into the jail for a DUI then you will have a minimum mandatory eight (8) hour hold (that does not include time at the police station being processed prior to being booked into the local jail) and if are booked for any sort of a domestic violence (DV) case then you will have a similar minimum mandatory twenty-four (24) hour stay in jail before you can be released.
Using Miami-Dade County as an example, and barring any min-mands or exceptional circumstances (regardless of their origin), you can expect an average of anywhere from six (6) to eighteen (18) hours from the time THAT BOND IS POSTED (it doesn’t matter when you get booked it ONLY matters from the moment that your bond is actually posted) until the time that you actually walk out of the jailhouse doors.
If you do not post bond then you will be taken before a Judge (in Miami this is done via CCTV from the jail) for an “initial appearance” where alternative bonds can be considered. And, if you are booked in for a non-bondable offense (i.e. either a life or a capital felony charge) then you will be held pending an “Arthur Hearing” which I will discuss in more detail in a future Webisode.
