Meet 32 year old Jacob Jeremy Mercer of Tonawanda, New York.  That’s his mug shot below…



Jacob, dressed head to toe as Darth Vader (complete with mask, cape and chest plate) botched a robbery of the “8 Till Late” convenience store in Jacksonville Beach, Florida and was arrested shortly thereafter.




Jacob entered the convenience store wearing the Darth Vader costume, armed with a gun, threatened the cashier and demanded money.  He would have been better off with a light saber because neither his gun nor “the Force” did anything to preclude the bottle of salad dressing that the cashier hurtled at him from hitting him square in the face and botching the armed robbery.




After being hit in the face with the bottle of salad dressing, and in a very un-Darth Vader like move, Jacob turned tail and ran away.  He was identified by a witness who saw him take off the mask, enter a vehicle and drive away.  Cops located Darth Jacob – who turns out to have been a convicted felon – a few blocks away, bleeding from the bridge of his nose (where the bottle of salad dressing landed) and in possession of a backpack which contained “several handguns and ammunition”.  Jacob was charged with armed robbery and possession of a firearm by a convicted felon and now faces life in prison.


Memo to the Folks:  In Florida armed robbery is a felony punishable by life, and in Florida “life in prison” means “life in prison”.  It means that, unless your case is either successfully appealed or you are pardoned (i.e. granted clemency by the Governor), you do not leave prison unless you are dead and your carcass is being carried out in a pine box.   

Memo to Jacob Jeremy Mercer:  You FAIL!ed on so many levels that it’s just amazing. Botching the robbery was classic, but doing so as Darth Vader is EPIC.  Tack on taking off your mask on scene so that you could be positively identified, then sprinkle using your own getaway car with NY plates in FL and then tack on being a convicted felon in possession of multiple firearms and you are now LEGEND.  



Memo to the Folks continued:  Jacob’s FAIL! is your gain.  Apart from the countless jokes and a very hardy chuckle, and above and beyond the obvious (i.e. not to commit armed robberies) we have learned so many things NOT to do from Darth Jacob.  F.S. 775.0845 (which you can view by clicking here) permits the State to reclassify an offense and to bump it up a level where one wears a mask while committing a crime (i.e. the same 3rd degree felony which is normally punishable by a max of 5 years jumps to a 2nd and is punishable by 15 years for nothing more than the offender wearing a mask during the course of the crime).   F.S. 775.087 (which you can view by clicking here) is also known as the “10-20-LIFE” law and basically holds that if you display a firearm during the commission of certain enumerated offenses (of which robbery is one) then you must serve a minimum mandatory 10 year sentence, if you discharge the firearm then its a 20 year min/mand and if anyone is struck with a projectile then you serve mandatory life.
