Q:     My son refused a breathalyzer. How long before he can be licensed again?  My son hit a telephone pole. No other cars were involved. After an hour or so he was asked to submit to a breathalyzer. He refused. He was not arrested nor ticketed for anything. no DUI no careless driving nothing. Later He was awoken in the middle of the night by two officers to sign something saying his license would be suspended for the refusal.

If you have further questions about the suspension then you can call the good folks at DMV in Tallahassee (850-617-2000). If you follow the rule of the 3 “p”‘s (be patient, pleasant and polite) you will be surprised at just how knowledgeable and helpful they can be.

I don’t know what your son signed but if I were you I would get off line and into a skilled and experienced Bartow area criminal defense lawyer’s office and let a trained practicioner physically view the document and give you an informed opinion as to what it means. It may very well be more complicated than the cops let you / your son to believe.

I hope that I have been helpful in answering your question.

When it comes to the subject of drinking and driving, the best advice that you are ever going to hear is:  “Don’t do it!  Get a DD (Designated Driver), not a DUI”.

Be smart: Don’t drink and drive, but, if you do, just say “NO{thing}”, don’t blow (in FL your 2nd subsequent refusal is a crime) and call me stat at 305-798-2220, **ARRESTED, **305DUI, **MIAMIDUI, **MIAMILAW or **HABERLAW.
