Q:     I have 50 Hours community service here in Duval County, FL. Can I pay off my hours to a charity?  I work 60-80 hours a week at night usually 6PM-6AM and parents havent been in the best health lately so ive been taking care of them in between, heard here in FL I could make a donation to a charity to cover my hours.

Answered If it is a condition of a Court’s sentence then is up to the individual Judge whether or not to convert CSH’s to a monetary fine; if it is pursuant to a diversionary plea / program then it is exclusively up to the State Attorney.

Your proffer suggests compelling reasons to amend the condition and permit the conversion (which is usually done at the rate of $10.00 / hr) but, again, you will need to seek and secure permission – beforehand.

My advise: DO NOT (caps intentional) wait until the term (probation / diversion / whatever) expires. Get in front of it and deal with it proactively. If you do not have a lawyer then get into an experienced J-ville area criminal defense attorney’s office (if you have one then get into yours) and have her / him take the appropriate action before you are playing defense.
