A Florida Man is Fatally Shot in the Chest after Putting on a Bullet Proof Vest and asking his Cousin to Test whether it “still worked”, which it did not, resulting in the Shooter’s Manslaughter… Scroll down to read more!




That, below, is, upon information and belief (and according to Wikipedia), the testing of an early (1901) bullet-proof vest, reportedly designed by Jan Szczepanik, by firing a 7 mm (yes, apparently they used 7 mm handguns in 1901) at a person wearing the vest (the results of the “test” are unreported).




Fast forward 115 years to Tampa, Florida in September, 2016 and introduce then 24 y/o Alexandro Garibaldi (mug shot below)…




For reasons unknown, on Saturday, September 10, 2016 Alexandro and his (former) cousin, 23 y/o Joaquin Mendez, decided to conduct a similar experiment.  Per Tampa Police Mendez put on the vest sat in a chair and “wondered aloud whether it still worked”, at which time Garibaldi pulled out a gun and responded, “Let’s see”, at which time he discharged the firearm directly at the vest.




Responding police officers found Mendez outside the house with a gunshot wound in his chest, sand the vest, which was discovered inside of the house, complete with a “projectile entrance hole.” Garibaldi reportedly told the cops that he had found his wounded cousin after hearing a gunshot, but an unnamed witness contradicted that story, telling cops that it went down as described above (i.e. Mendez had put on the vest, sat in a chair and “wondered aloud whether it still worked”, at which point Garibaldi pulled out a gun, responded, “Let’s see” and pulled the trigger).


Mendez was alive when police arrived but later died at a hospital, and Garibaldi was arrested for manslaughter.



Memo to the Folks:  Manslaughter is a form of homicide and is a “lesser” offense to murder, the main difference being a lack of intent – specifically what we call “premeditation”.  




Memo to the Folks continued:  Manslaughter comes in two forms; it can either be voluntary or involuntary.  Voluntary Manslaughter, which is the more serious of the two, occurs where there is either an intent to kill or to cause serious bodily harm (although not a pre-formed intent to kill… for example walking in on your spouse in flagrate dilecto with her/his paramour, immediately pulling a gun, shooting and killing one or both of them in the “heat of passion”) whereas involuntary manslaughter occurs where a killing occurred but there was no criminal intent whatsoever, for example…




Memo to Alexandro Garibaldi:  You should spend your time in prison (yes, you are almost certainly going to prison) reading, studying and learning.  Still do not expect a MENSA invitation any time soon…
