What is Improper Exhibition of a Weapon / Firearm in FL?
Florida Statute 790.10 makes it a crime for a person to exhibit a weapon or firearm in a “rude, careless, angry, or threatening manner in the presence of one or more other persons”, but it is not a crime if the exhibition is done in self-defense.
And no, having a concealed weapons permit will not get you out of an improper exhibition charge. Why? Because the whole idea of having a concealed weapons permit is to keep your weapon hidden from plain view.
Interestingly, no matter how many people may be present when you improperly exhibit your weapon or firearm, so long as the incident occurred in a single criminal episode, in FL you can only be convicted of one count.
Improper Exhibition is a 1st degree misdemeanor and is punishable by up to 364 days in a local jail.
