Thank you for asking me “What is Theft in FL?”
Theft is stealing.
Essentially a theft occurs where someone takes something that belongs to someone else, but, as with most things, the law has a more detailed definition.
In FL theft occurs where:
1) You knowingly and unlawfully obtain or use, or endeavor to obtain or use the property of another; and 2) At that time you had the intent to either: A) Deprive the victim of the right to or a benefit from the property or B) to appropriate the victim’s property to your own use or for that of another.
In FL the crime of theft varies based upon the value of the property in question.
From lowest to highest: If the property is valued at less than $100 then it’s a 2nd degree misdemeanor petit or petty theft which is punishable by up to 60 days in jail; if the property is valued in between $100 and $300 then it’s a 1st degree misdemeanor petit or petty theft which is punishable by up to 364 days in jail; $300-$20,000 is a 3rd degree grand (felony) theft, punishable by up to 5 years in prison; $20,001 – $100,000 is a 2nd degree grand (felony) theft, punishable by up to 15 years in prison and if the theft is greater than $100,000 then it’s a 1st degree grand (felony) theft, punishable by up to 30 years in prison.
In FL there are a bunch of exceptions to the general rules – for example if you steal a fire extinguisher, a stop sign or any amount of any controlled substance then, regardless of the actual value you have committed a 3rd degree felony.
