Thank you for asking me “What is Home Invasion Robbery in FL?”
Home invasion robbery is essentially a robbery that occurs when the offender enters someone else’s home with the intent to commit a robbery and the subject in fact commits a robbery of anyone who is inside of the house at the time.
In order to prove the crime of home invasion robbery the State must prove the following elements:
1) That the Defendant entered the victim’s dwelling; 2) At the time of entry the Defendant intended to commit a robbery; 3) While inside the dwelling the Defendant did commit a robbery; meaning that: 3A) The Defendant took property either from the person or the custody of another; 3B) That “force, violence, assault or putting in fear” was used during the course of the taking; 3C) That the taken property had some value; and 3D) That the taking was done with the intent to deprive the victim of the right to or a benefit from the property so as to either use it for the Defendant’s own or for the use of someone else who wasn’t entitled to use it.
Home invasion robbery, with or without a weapon, is always a 1st degree felony (punishable by up to 30 years in state prison) but if a home invasion robber or any conspirator or principal is armed with a weapon then home invasion robbery is a 1st degree “PBL” felony, punishable by life in prison (and in FL “life” means “life”… it means that you may well leave prison in a pine box).
