Thank you for asking me “What is the difference between a Domestic Violence Restraining Order / DVRO and a Stay Away Order?”
The effects are similar but the differences are great.
A DVRO is a civil court order that gives a victim of domestic violence protection from their aggressor. A DVRO is designed to preclude any contact whatsoever, whether direct or indirect, whether in person or by third parties, by electronics or through any other means, and it may also award such things as exclusive use and occupancy of a shared residence and temporary child custody.
A Stay Away Order is a condition of bond that is ordered by a criminal court Judge and which, like a civil DVRO, gives a victim of domestic violence protection from their aggressor by precluding any contact whatsoever, whether direct or indirect, whether in person or by third parties, by electronics or through any other means, while the Defendant is out on bond.
If you violate a DVRO then you have committed a crime (“Violation of an injunction for protection against domestic violence”, see F.S. 741.31) as well as risking a charge of criminal contempt of court.
If you violate a SAO then you have violated a specific condition of bond, subjecting your bond to revocation and you to incarceration until you underlying criminal case is closed, as well as a possible contempt of court charge.
And if you violate both a DVRO and a SAO, well then you are in for a world of hurt.
