Thank you for asking me “What do I do if I can’t make payments to my lawyer?”
If you’re making payments to your lawyer then you probably have a contract, and if you fail to make your contractual payments to your lawyer then the lawyer can seek to withdraw from your case.
That is a big problem with payment plans.
It’s like leasing a car or renting an apartment.
Everything is cool until you stop making your payments.
And it’s not really a matter of “why”… it just is.
Think about it for a second.. Do you think that your landlord would wait for your tax return? Probably not.
If you can;t make your payments to your lawyer then you’d best dhave a face to face and discuss the situation asap. You should find a way to meet your financial obligations to your attorney or be prepared to either hire another lawyer or to try to get court appointed counsel.
Every lawyer has the right to run their practice – their business – as they see fit. Personally I do my best to deter folks from making payments with my law office, but when I do I have an iron clad contract which states the client’s financial (and other) obligations to me, and vise-verse (my duties to the client) and which permits me to withdraw for failure to make timely payments. I explain to the client that I will withdraw pursuant to the contract if I must, but that I would prefer not to be retained in the first place (because I’d rather be the Mercedes that you could not lease than the Benz that got re-possessed because you couldn’t pay).
