Thank you for asking me “What Drugs can I get charged for Trafficking in in FL?”
The list of controlled substances – a/k/a illegal drugs – in FL is extensive, overwhelming even (if you want to see an exhaustive list of the hundreds and hundreds of controlled substances in FL then take a look at F.S. 893.03), but in FL you can only be charged with trafficking for precious few of those hundreds of controlled substances.
Remember, what differentiates possession of a controlled substance from trafficking is nothing more than the weight, or the amount of the drug that you possessed when you were arrested.
But if the controlled substance in question does not fall into one of the twelve (12) categories that are outlined in F.S. 893.13 (the trafficking statute) then, no matter how much of it you have you cannot be prosecuted in State Court for trafficking… possession with intent maybe, but not trafficking, and only trafficking carries minimum mandatory sentences. (Note though that PWID is a more serious crime then simple possession, being a 2nd degree felony punishable by up to 15 years in prison).
That said, the controlled substances that subject you to a trafficking charge in FL State Courts are: Marijuana, Cocaine, most Opiates, PCP (a/k/a “Angel Dust”), Quaaludes, Amphetamines and Methamphetamines, Rohypnol (or “Roofies”), GHB, GBL, MDMA (a/k/a “Ecstacy”) and LSD.
If it’s not on that list then, no matter how much of it that you possess, you can’t be charged with trafficking in FL State Court.
So, for example, you could get caught with 100,000 xanie bars or 100,000 milligrams of anabolic steroids and while you can be charged with either possession or possession with intent to distribute, you cannot be charged in FL State Court with trafficking.
Note again that while you may be subject to federal trafficking charges you will not be subject to FL state court drug trafficking charges.
