Thank you for asking me “What is “Drug Court”?”
In a nutshell, Drug Court is a1n alternative that offers eligible drug offenders an opportunity to avoid criminal prosecution, to recover from addiction and to change their lives in a positive direction. In this sense Drug Court is a diversion program, just like PTI or PTD.
The main components of drug court are:
1) Early identification of eligible offenders (usually first timers); 2) Diversion from what would otherwise be a routine criminal prosecution; and 3) Rehabilitation by way of intensive supervision by the Drug Court Judge and various treatment specialists.
Although in the end Drug Court works like PTI there are three major differences.
1) Unlike PTI, drug court diverts you out of the criminal justice system, but only if you both accept and meaningfully participate in a prolonged and extremely regimented treatment program.
2) Also unlike PTI, which is owned, operated and overseen by the State Attorney’s Office, Drug Court is owned, operated and overseen by the Court.
3) Unlike traditional PTI, where you might have to take a class or do some community service hours but which essentially boils down to just managing to stay out of trouble for a period of time, in Drug Court you will be tasked with working very hard to earn your dismissal.
It isn’t easy to accomplish but if you do, then successful completion of Drug Court will not only resolve your criminal court problem but may very well save your life.
