Thank you for asking me “What is Knowing Transmission of a STD?”
STD’s are sexually transmitted diseases, and under F.S. 384.24, the crime of Unlawful Sexual Intercourse with STD is committed by a person who:
1) Knows that s/he is infected with a specified sexually transmissible disease 2) Has been informed they could transmit the disease to another person, 3) And then engages in sexual intercourse with another person without first disclosing the existence of the STD.
The STD’s subject to this offense limited to are: Chancroid, Gonorrhea, Granuloma Inguinale, Lympho-granuloma Venereum, Genital Herpes Simplex, Chlamydia, HIV, Nongonococcal Urethritis, Pelvic Inflammatory Disease (PID), and Syphilis.
Knowledge of the STD can be proven either actually (meaning that the person was formally diagnosed with a STD by a medical professional) or constructively (meaning that the person had provably experienced the obvious symptoms of a STD, such as rashes, genital warts, or discharge).
Failure to disclose the STD is not enough; for a crime to occur the State has to prove that the STD was knowingly transmitted to another.
The bottom line is that if you have a STD then please, pretty please, before getting intimate with anyone else fess up. Let your would-be partner make a knowing decision and don’t force your coodies on them.
Unlawful Sexual Intercourse with STD is a 1st degree misdemeanor unless the sexually transmissible disease is HIV, in which case the crime is classified as a 3rd degree felony.
