Thank you for asking me “If I know that I’m gonna Fail a Drug Test, should I just not Take it?”
This is one of those questions that is best answered with a question…
Which would you prefer to happen to you: Would you rather be punched in the face by Mike Tyson or kicked in the head by Chuck Norris?
If you are on pretrial release, pretrial diversion. probation, community control or parole then you are both subject to drug testing and are required to be drug free (drug free meaning that you cannot use any controlled substances that you don’t have a valid Rx for).
The hands down best decision that you can make is to take your pretrial release, pretrial diversion. probation, community control, parole… whatever form of supervision that you are subject to that requires drug testing seriously, and DO NOT USE controlled
substances during that time.
The bottom line is that if you use, you lose; similarly, if you blow off your urinalysis then you also lose.
There are not many “constants” in the law but one of them is that neither prosecutors nor Judges look favorably on those who squander the opportunity that they’ve been given to be on bond, to earn a dismissal or to serve a community based sanction instead of being in custody by using controlled substances, which is a willful and substantial violation.
