Thank you for asking me “What can I do if my Prosecutor won’t Plea Bargain with me?”

Practical realities (such as internal office policies, pressure from the Court, having too heavy a case load, prioritizing cases for more serious offenses or offenders or having evidentiary issues with a case) can and do effect a Prosecutor’s willingness to plea bargain, but a prosecutor has no legal obligation to either offer you a plea bargain or to negotiate a lower sentence in your case.

Where a prosecutor refuses to offer you a plea bargain for a more lenient sentence here are some of your options:

1) You are always free to bypass the prosecutor and plead straight up to the court; 2) You can build a solid defense (whether based on the evidence or with the use of expert witnesses) and prove your way into a better plea offer; 3) You can proceed to trial; 4) You can try to stall your case until your prosecutor is reassigned and a new one takes over; 5) You can try to go over your prosecutor’s head to her or his supervisor; 6) You can find yourself another lawyer who has a better “relationship” with a hostile prosecutor.

But what you cannot do is either force a prosecutor to offer you a plea bargain or a more lenient sentence.
