Thank you for asking me “What is a “Wet Reckless?”
“Wet Reckless” is not a crime in FL.
Rather, “Wet Reckless” is a term that’s commonly used where a DUI charge has been reduced, or “broken down”, from DUI to Reckless Driving.
Both DUI and Reckless Driving are criminal traffic offenses but, on the continuum of “bad to worse”, Reckless Driving is bad and DUI is worse.
A breakdown from DUI to Wet Reckless can happen for a variety of reasons.
Some of the most common are: Successful completion of a DUI diversion program, getting a favorable ruling on a non-dispositive Motion to Suppress, the State having a non-fatal evidentiary or witness problem or the defense piecing together and proffering a case that’s strong enough to cause the State some trepidation about it’s odds of winning.
Most times a wet reckless is considered to be a win. Why? Because unlike a DUI, reckless driving (wet or dry) doesn’t carry any of the plethora of minimum mandatory penalties that are required by statute if you’re convicted of DUI, plus, unlike DUI, you can get a withhold of adjudication on a wet reckless.
Still, before you either enter into DUI diversion or otherwise accept a wet reckless please talk to your lawyer about the relative strengths and weaknesses of your case, and make sure that accepting a breakdown is in your best interests.
