Almost all DUI cases stem from some sort of innocuous non-criminal, run-of-the-mill and otherwise routine traffic stop, during the course of which the officer will allege that s/he developed reasonable suspicion to further detain you and to conduct a DUI investigation.
Obviously I do not know the facts and circumstances of your case (nor do I want you to post them here…) but, were I a betting man, then I’d wager that your paperwork reads something like this:
“While on routine patrol I observed the Defendant (insert traffic violation here). I activated my emergency equipment and the Defendant driver came to a stop (insert manner of stop here). I approached the driver and, upon asking for his license, registration and proof of insurance, I noticed that he had (some combination of – more like all…) bloodshot and watery eyes and I detected a strong odor of an alcoholic beverage emanating from his person. Upon engaging in conversation I noted that the Defendant also had slurred speech. I asked the Defendant to step outside of his vehicle and offered him FST’s (fields sobriety “tests”) on a smooth, level and well-lit surface. The Defendant failed to perform to standards so he was taken to the station for further testing. (Insert results of breath test or refusal information here.)”
Unless your arresting officer was asleep during the “DUI for Dummies” block at the police academy (where all potential cops are taught to memorize and recite the magic buzz words for each and every DUI arrest – lest a smarmy defense lawyer should rip them a new one in Court), that, or something very similar to that, will be the essential police version of events in your case. Absent a dash cam or other video to the contrary, your case will likely boil down to the officer’s word against yours (i.e. the individual who is sworn to uphold the law wearing the freshly pressed uniform with the American Flag stitched on the sleeve and the shiny badge and shoes who swears on a busload of Bishops and a Cardinal too boot that s/he has no horse in the race, doesn’t care what the Judge or Jury does in Court and who’s only concern was getting a potentially dangerous person off of the road because that is her/his job vs. you… the Defendant… the only person in the Courtroom who cares about the outcome of the case).
That said, DUI’s are also defendable, but effectively doing so requires skill, experience and a DUI lawyer who knows where to look for the weaknesses, inconsistencies and other avenues of potential reasonable doubt.
