Bond is a mechanism by which someone who is taken into custody for a criminal violation can secure their release from jail. It usually involves money, but not always. Sometimes property can be used as collateral. In Florida a cash bond can generally be posted by anyone, but if you don’t have enough cash to cover the full bond then a surety (a/k/a a bondsperson or bail-bondsperson) can be used to post your bond for you in exchange for the payment of a “premium” (i.e. a fee – which, in Florida, is always ten percent (10%) of the full bond amount). The premium (or fee) is earned by a surety for their service in accepting the financial responsible for the person who is being bonded out during the pendency of their case.
In Florida anyone who is arrested for a felony which is NOT punishable by either life or death (i.e. anything from a 2nd degree misdemeanor to a non-“PBL” 1st degree felony) is entitled to bond by both the Florida Constitution and Florida Statutes. Most Florida Counties have “standard” bond schedules – meaning that for every offense on the books there is a predetermined “standard” bond. When you are booked into a local jail if there is a standard bond (and assuming that you have no other holds or collateral barriers to being released) then you are immediately bondable. If you are booked in on either a non-bondable offense (i.e. for a felony which IS punishable by either life or death) or if you have another hold or if there is another collateral barrier to your being released, then you will need a criminal defense lawyer to assist you in attempting to secure your release.
Again, absent laying out the full bond amount in cash, only a licensed and bonded surety agent can post bond in Florida. Lawyers can NOT post bond. If you or yours get arrested for a bondable offense then call a bondsman first and a lawyer second. You will need a lawyer to assist you with your case but you will need the bondsperson to assist you in getting out of jail first.
