“How can I be Arrested when there’s No Evidence?”
Here’s the scoop… You may or may not appreciate the evidence, and there may or may not be a lack of evidence or significant conflicts in the evidence, but when allegations are made cops do an investigation (which may amount to little more than a lame, pathetic excuse for an alleged investigation) and then they make an arrest, but they must first lay out facts which demonstrate PC (“probable cause”) for the arrest.
From there the State Attorney’s Office is supposed to do a more thorough analysis of the facts, circumstances and evidence (whether they do or not is anyone’s guess) and then the cards fall where they fall. If there is sufficient PC and the State Atty believes that they can prove their case beyond a reasonable doubt with substantial and admissible evidence then you will be formally charged, and if not the you won’t.
The cops have a saying: “You might beat the rap but you won’t beat the ride”. This means that you cannot stop a cop from arresting you, but you may be able to get your case “no actioned” and avoid being formally charged by the State.
The best way to try to accomplish this is to let a skilled and trained professional assist you in piecing together a viable defense right up front. Lack of evidence is a good start, but it isn’t everything (plenty of folks are sitting in state prison or local jail without any physical evidence of their crime and merely based on the credibility of the State’s complaining witness.
