Thank you for asking “Was I Entrapped in a Drug Sting”?
So you are out of town with your buddies at a bachelor party in Las Vegas and you are looking to score some coke (not the soda variety).
You remember that when you checked into the hotel one of the valet’s told you that if you need anything… “anything” (wink wink) to make your stay in Vegas more enjoyable then just ask because he has connections for whatever you want. And so you do. You ask him to hook you up with an 8-ball and he says “no problem, meet me by the men’s room at 2pm with $100 cash”.
Come 2 pm and you are waiting by the men’s room with a crispy beaner in hand, and up comes the valet. You do the old swaparoo and as you walk away 2 cops approach, grabbing you by each arm and they escort you to their squad car.
In this example the cops clearly used methods of persuasion to induce you to commit a crime, but the law permits them to do this- and be clear that they can and do use trickery or subterfuge – including using CI’s (confidential informants) – to provide folks with the opportunity, means or facilities to commit a crime.
So… in this example were you entrapped? Definitely not. Why? Because entrapment sinks or swims on the issue of your predisposition to commit the crime regardless of the cops providing the party favors.
The question in this case is whether or not you would have bought the coke if the seller hadn’t been working with the cops, and clearly you would have.
