“What is the crime of “Battery”?
The crime of Battery can be as simple as an “intentional and unlawful touching” or as complex as inflicting great bodily harm on another personal. The main elements of battery are the intent to touch or strike a person against their will and that some harm to the other person occur.
A battery can occur where you simply touch someone who does not want to be touched or where you set an object in motion which touches someone who didn’t want to be touched by the object (for example, a spit ball or spit even, can cause a battery).
“Simple” battery results in no significant injury and is a 1st degree misdemeanor, but in FL if you rack up 3 or more simple batteries then they are treated as a 3 degree felony. rd
3 degree Felony battery is an intentional and unlawful touching rd which unintentionally causes either great bodily harm, permanent disability, or permanent disfigurement.
Aggravated Battery is a 2 degree felony and is an intentional nd and unlawful touching which either intentionally causes great bodily harm, permanent disability, or permanent disfigurement or which causes such harm by way of using a deadly weapon.
And if a firearm is used during a aggravated battery then it is reclassified as a 1st degree felony.
