That Max killed his also 16 y/o friend Ryan Mangan (who is pictured below) at Ryan’s home on February 4th, 2015 by fatally shooting him in the face is not at issue; whether it was intentional or nor is being contested.





Max claims that the killing was an accident and that he did not intend to kill his buddy.  Max claims that he and Ryan were horsing around with a loaded gun when Ryan was shot in the left eye.  Max claims that the “Selfie” at issue (more on that below) was him trying to take a picture of Ryan with a cellphone aimed down the barrel of a 9mm pistol before the trigger was accidentally pulled, but the social media evidence suggests a contrary conclusion.  Apart from the brainless nature of the deed (giving new meaning to the term “photo shoot”) Max had the temerity to send the “selfie” to another friend via Snapchat, along with some poorly chosen words.




Still, Max claims that he “panicked” and took the “selfie” to send to a friend via Snapchat as mere “proof”, after his out-of-State friend refused to believe what Max claimed had just happened.  On Wednesday, April 1st, 2015, at a preliminary hearing in the Westmoreland County Courthouse, Judge Joseph DeMarchis ordered Max stand trial for first-degree murder and possession of a firearm by a minor.  The decision was bolstered by Detective Bob Weaver’s testimony that Max had sent the “selfie” of Ryan’s body slumped over a chair via an Xbox to another friend in Wisconsin, allegedly boasting, among other things, that he had just “got his first body”.  Testimony was also elicited that when the police came to interview Max a day after the shooting he confessed, saying: “I just shot him. it didn’t matter, and I don’t care.”





Ryan, who was a junior at Jeannette High School, where Max was also a student, was found dead around 6:00 pm on February 4th, 2015  by his mother, Rebecca Murtland.  Investigators at the scene found a 9mm shell casing but a handgun was not recovered at the time; but a 9mm handgun was later recovered from the basement of the home.  




The day after Ryan was found, a mother of one of Max’s friends told the police that her son had received a “selfie” from Max on Snapchat of the victim who was sitting in a chair with a bloody wound to his face.  Max’s friend saved the image before it deleted itself, as Snapchat lets users send images that are removed from the recipient’s phone after a few seconds.  The unidentified friend’s mother also said her son had received messages from Max that said: “I told you I cleaned up the shells”, “Ryan was not the last one” and “got my first body.”





District Attorney John Peck said that based on the evidence and Max’s own statements the shooting was not accidental and “the suspect’s actions afterwards show a callousness of guilt.”
